I know of several Elderly Senior Citizens who have been Threatened with liens and non-judical foreclosure of their homes by their HOA.
Not just for a late, missed, or forgotten maintenance fee/comunity dues/an Assessment...but also for a deed restriction violation, or should I say anĀ interpretation of a deed restriction or a violation of the community rules, its policies & or it's so-calledĀ governing CC&R's.
Which by the way, Are soley written up, are solely interpreted by & are soley enforced by: The Board of Directors and their solely appointed committee's who also allow the board to hold a mock trial with the members acting as police, judge,& jury... Where they are also allowed to convict & carry out a sort of execution against the accused homeowner. All without the accused homeowner/ his or her right of Due Process being allowed to enter into the equation.
The only exception to this Mock Trial is: 1.Currently being a board or committee member. 2. Being a past board or committee member. 3. Being a current friend, family member, part of the click, or one of the yes-men who help to intimidate and help to ostracize any homeowner who would stand & ask the board questions, or would fight for Equal Rights, or a homeowner who might want an Audit done, or a homeowner who asks that the Board enforce the same rules equally towards All Owners - to include the other board members, their appointed committee members, and to include their friends along with the yes men who help to oppress the other homeowners by using harassment, intimadation and or Scare tactics so that other homeowners will no longer wish to partisapate in the so-called self-governing process that is suposedly taking place in the Gated Senior Citizen's Community. The same gated community that the elderly have sunk their hard earned retirement money into a home.
The other homeowners (not in the clique) who dare to challenge the authority and overzealousness of the board members face eminent danger. But those who fall in line... they are given waivers, a pass of forgiveness, or the violation is labled as a "Soft Violation" not worth the board's time writing a violation letter for. Reply to this
